Can the seller take the light, television, or refrigerator?

How property ownership and home transactions work

1 · Start with the idea

A movable object can become part of real property when it is attached in a way that shows it was meant to stay. But some items are genuinely disputed. The safest transaction is the one that names important items in writing before anyone argues about them.

2 · Picture it

A chandelier is wired into the ceiling and usually looks like part of the room. A floor lamp is simply plugged in and can be carried away. A wall-mounted television can be trickier because the bracket and the television may be treated differently.

3 · Now learn the English words

fixturean item that was personal property and has become part of the real property through attachment
agreementwhat the parties have expressly decided in writing about the item

4 · Why this matters

The professional lesson is not to win an argument about classification. It is to prevent the argument by identifying disputed items clearly in the agreement.

5 · Check yourself

What is usually safer: arguing later about whether an item is a fixture, or naming the item in the agreement?

Show answer

Naming it clearly in the agreement.
